Terms of Service

These Terms of Service ("Terms") govern your use of PoolBidding, a product of 7e Digital LLC ("we," "us," or "our"). By signing up or using the service, you agree to these Terms.

1. The Service

PoolBidding is a web-based proposal and estimating tool for pool construction companies. We provide the software on a subscription basis.

2. Your Account

• You are responsible for keeping your login credentials secure.
• You must be authorized to enter into this agreement on behalf of your company.
• You are responsible for all activity that occurs under your account.

3. Subscription and Billing

• Subscriptions are billed monthly or annually via Stripe.
• A 14-day free trial is available. No credit card is required to start the trial.
• You may cancel at any time from the Admin > Subscription page. Cancellation takes effect at the end of your current billing period.
• We do not offer refunds for partial billing periods.

4. Your Data

• You own your data. We do not claim any rights to the proposals, customers, or pricing information you enter.
• You can export your data at any time from within the application.
• Upon cancellation and written request, we will delete your data within 30 days.

5. Acceptable Use

You agree not to use PoolBidding to:

• Violate any applicable law or regulation.
• Attempt to gain unauthorized access to any part of the service or its infrastructure.
• Resell or sublicense access to the service without our written consent.

6. Uptime and Service Availability

We make reasonable efforts to keep PoolBidding available but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance when possible.

7. Limitation of Liability

To the maximum extent permitted by law, 7e Digital LLC is not liable for any indirect, incidental, or consequential damages arising from your use of PoolBidding. Our total liability for any claim is limited to the amount you paid us in the 3 months preceding the claim.

8. Changes to These Terms

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the service constitutes acceptance of the updated Terms.

9. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.
